1. Introduction
These Terms of Service ("Terms") govern your use of the Bloomoo platform ("Service"), operated by Bloomoo ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
2. Service Description
Bloomoo is a psychometric assessment and self-development platform that provides:
- Free assessments: Validated psychometric instruments measuring personality traits and tendencies
- Paid training programs: Self-development content based on assessment results
- Company-sponsored assessments: Assessments initiated by an employer or organization, with results shared only via explicit consent
3. Account Creation and Responsibilities
3.1 Eligibility
You must be at least 16 years of age to create an account. By creating an account, you represent that you meet this requirement.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account.
3.3 Accurate Information
You agree to provide accurate and current information when creating your account and completing assessments. Assessment results depend on the accuracy of your responses.
4. Data Ownership and Processing
4.1 Your Data
You own your personal data. By using the Service, you grant Bloomoo a limited license to process your data solely for the purposes described in our Privacy Policy.
4.2 Consent-Driven Access
Companies can only access your assessment results if you grant explicit Company Access Consent. This consent is:
- Granted per company
- Revocable at any time
- Independent of other consents
Revoking Company Access Consent immediately removes the company's ability to view your results.
4.3 Data Deletion
You may request deletion of your account and all associated data at any time. Deletion requests are processed within 30 days. Certain records may be retained where required by law (see Data Retention Policy).
4.4 Data Portability
You can export your data in a machine-readable format at any time through your account settings.
5. Non-Clinical Nature of the Service
Bloomoo is NOT a clinical, diagnostic, or therapeutic tool.
- Assessment results describe personality traits and tendencies; they do not diagnose conditions
- Results are based on validated academic instruments and are informational only
- The Service is not a substitute for professional psychological, psychiatric, or medical advice

5.1 Emotional Impact
Assessment results may sometimes be surprising or confronting. By using the Service, you acknowledge that you are responsible for how you interpret and act upon your results. If any results cause concern, we encourage you to consult a qualified professional.
5.2 No Outcome Guarantee
Bloomoo does not guarantee any specific personal, professional, or relational outcomes from assessments or training programs. Results and recommendations are informational tools, not guarantees of improvement or change.
6. Assessments and Instruments
6.1 Instrument Sources
Assessments are based on academically validated, open-access psychometric instruments. We do not create proprietary diagnostic tools.
6.2 Scoring
Scoring follows the standardized methodology documented for each instrument. Scores are computed deterministically from your responses.
6.3 AI-Generated Content
With your consent, AI models generate personalized summaries and recommendations. These are supplementary interpretations, not clinical assessments. AI-generated outputs are probabilistic in nature and may contain inaccuracies, oversimplifications, or generalizations. They should be considered as one perspective among many. You can revoke AI Usage Consent at any time, which will delete all AI-generated content.
7. Paid Services
7.1 Training Programs
Some training programs require a one-time purchase. Prices are displayed inclusive of applicable VAT where required by law. The total amount payable, including any taxes, is shown before order confirmation.
7.2 Payment Processing
Payments are processed by Stripe. We do not store your payment card details.
7.3 Refunds
If you have waived your right of withdrawal by requesting immediate access to digital content (see Section 7.4), refunds are not available once access has begun. In all other cases, you may request a refund within the statutory withdrawal period. Any applicable refund policy is communicated at the point of purchase.
7.4 Right of Withdrawal and Digital Content Waiver
Under EU Directive 2011/83/EU, you have a statutory 14-day right of withdrawal for online purchases. However, by purchasing digital content or training programs and requesting immediate access, you expressly consent to the immediate performance of the contract and acknowledge that you lose your statutory 14-day right of withdrawal once access has begun.
This waiver is collected via a mandatory, non-pre-ticked checkbox at checkout. The timestamp, user identity, and version of the waiver wording are recorded for compliance purposes.
8. Intellectual Property
8.1 Platform Content
The Bloomoo platform, including its design, code, and original content, is owned by Bloomoo and protected by applicable intellectual property laws.
8.2 Instrument Licensing
Psychometric instruments used on the platform are sourced from academic research under their respective open-access licenses. Attribution is provided where required.
8.3 Your Content
You retain ownership of your assessment responses and personal data. AI-generated summaries based on your data are provided to you under a personal-use license.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to other users' data
- Interfere with the operation of the Service
- Use automated tools to scrape or extract data from the Service
- Misrepresent your identity or provide false information
- Use assessment results to discriminate against individuals
10. Limitation of Liability
10.1 Service Provided "As Is"
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of assessment results.
10.2 No Professional Advice
Nothing in the Service constitutes professional psychological, medical, or career advice. You should not make significant life decisions based solely on assessment results.
10.3 Limitation
To the maximum extent permitted by law, Bloomoo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Nothing in these Terms excludes or limits liability where such exclusion is not permitted under applicable consumer protection law.
11. Termination
11.1 By You
You may terminate your account at any time by requesting account deletion. Upon termination, your data will be processed according to the Data Retention Policy.
11.2 By Us
We may suspend or terminate your account if you violate these Terms. We will provide reasonable notice where possible.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of France, without prejudice to mandatory consumer protection laws applicable in your country of residence. Any disputes shall be resolved in the competent courts of France, unless otherwise required by applicable consumer protection law in your country of residence.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Force Majeure
Bloomoo shall not be liable for any failure or delay in performing its obligations under these Terms resulting from events beyond its reasonable control, including but not limited to: hosting or infrastructure outages, payment processor downtime, AI provider service interruptions, natural disasters, government restrictions, or other force majeure events. In such cases, Bloomoo will use reasonable efforts to restore the Service as promptly as possible.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
